INFOCIP declared the conclusions of the conference for “Thematic National Assessment of judicial review deadlines and submission of decisions of the Administrative Court”
INFOCIP declared in the presence of the highest authorities of the executive, the judiciary and international actors that implement the program in the justice system for “Thematic National Assessment of judicial review deadlines and submission of decisions to the Administrative Court in RSH”.
This monitoring is realized for the first time. It has full range in the national plan, thereby setting a milestone in the field of thematic monitoring subsystem of the administrative court.
The study is an innovation in the concept that are used and in the way of executing as well. The approach that was used is unique, designed by INFOCIP, to provide maximum efficiency in legal terms contrasting with concrete findings obtained from monitoring court records.
Is a fact that the law 49/2012 for “On the organization and functioning of administrative courts and administrative disputes” as regards judicial review assigns explicit deadlines of decisions and delivery, providing a real opportunity for accurate measurements in terms of respecting (overcome ) of these terms.
The thematic evaluation for 2015 has expanded its focus, including methods to measure the limits of judicial review for the first time. It is also an absolute novelty, not only within the estimates of INFOÇIP, but also at the national level. For the first time there are real opportunities to assess administrative trial delays. In general, according to the jurisprudence of the GJEDNJ, is calculated from the moment of filing the petition and until delivery of the final decision with the court.
